Communique - regarding Case Rompetrol 2

DIICOT conveyed on 9 December 2019 to the companies KMG International NV (“KMGI”), Oilfield Exploration Business Solutions SA and Rompetrol Rafinare SA, the Ordinance dated 5 December 2019, issued in the criminal case no. 225/D/P/2006.

Through this Ordinance, the prosecution dismisses the criminal charges pending in the case and lifts a vast majority of the precautionary measures imposed previously by DIICOT Ordinances of 6 May 2016, as reconfigured through Ordinance dated 18 April 2019.

By the said Ordinance of 5 December 2019, a temporary precautionary seizure was kept over for limited period of time of 30 days, over four (4) installations of Rompetrol Rafinare, up to the amount of approx. USD 106 million.

We mention that this temporary seizure over these 4 installations has no impact at all over the Rompetrol Rafinare activity and Rompetrol filling station network.

KMG International is one of the most important economic players in Romania, meeting to date its commitment to contribute to the development of Romania as an energy hub in the Black Sea region. Thus, KMG International has made investments worth about $ 4 billion since 2007 in the local market, in operations performed by more than 5,000 employees in Romania. During 2007-2014, the Group contributed more than $12 billion to the Romanian state budget.

KMG International established jointly with the Romania state an Investment Fund, the Kazakh-Romanian Investment Fund, with a capital contribution of 150 million dollars and pursuing total assets of up to USD 1 billion, depending on market conditions. Projects worth over USD 250 million have already been identified and started to be implemented within the Fund to generate a strong positive impact both economically and socially.
